WHAT IS BURGLARY?
Although often confused with robbery or theft, burglary is actually neither. Burglary is a trespass crime. Burglary is committed when someone trespasses on another’s property with the intent to commit a crime inside. The intended crime is often Theft, but it could also be battery, sexual assault, criminal mischief, etc. Even if the intruder failed to complete the intended crime, burglary when he entered the premises.
DEFENSE STRATEGIES
Sometimes, the question is did any burglary actually occur or was the accusation false or staged. Other times, the issue is whether the burglary was done by the accused or someone else. In other cases, the issue is whether the accused intended to commit any crime other than, perhaps, the trespass itself. There are also cases where the question is whether there was a trespass in the first place, or did the accused have some right to be on the premises. The defense strategy and tactics will vary depending on the issues in dispute.
Sometimes, innocence is not the issue, and defense counsel works to mitigate the client’s risks. Residential burglary is particularly serious, as the sentencing guidelines call for a state prison sentence, even for the first offender. Even more serious are the aggravated forms of the crime, such as armed burglary or burglary with an assault or battery. Those are each first degree felonies, convictions for which will result in state prison sentences.
